Business Fuzion Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the website, software platform, and services (collectively, the “Services”) provided by Business Fuzion, LLC, a Florida limited liability company (“Business Fuzion,” “we,” “us,” or “our”).
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
1. Eligibility
You must be at least 18 years old and have the legal authority to enter into this agreement to use the Services. By using the Services, you represent and warrant that you meet these requirements.
2. Description of Services
Business Fuzion provides access to a white-label customer relationship management (CRM) and business automation platform, along with optional digital products, training, memberships, and coaching services.
The platform may include:
CRM tools and dashboards
Marketing and communication automations
Messaging (SMS, email, voicemail, etc.)
Analytics and reporting
Integrations with third-party services
3. White-Label & Third-Party Platform Disclosure
Business Fuzion operates a white-label platform built on third-party infrastructure, including GoHighLevel and other service providers.
While Business Fuzion controls branding, onboarding, and support, certain technical services (hosting, messaging delivery, data processing) are provided by third parties. Your use of the Services is subject to the acceptable use and technical limitations of these providers.
4. Account Registration & Security
You agree to:
Provide accurate and complete account information
Maintain the confidentiality of your login credentials
Notify us immediately of any unauthorized access
You are responsible for all activity occurring under your account, whether authorized or not.
5. User Responsibilities & Acceptable Use
You agree not to use the Services to:
Violate any law or regulation
Send spam or unsolicited messages
Engage in deceptive, misleading, or abusive practices
Infringe intellectual property rights
Upload malicious code or harmful content
Harass, threaten, or exploit others
Business Fuzion reserves the right to suspend or terminate accounts that violate these Terms or applicable laws.
6. Messaging, Email & TCPA Compliance
If you use the Services to send SMS, email, or automated communications, you are solely responsible for compliance with:
Telephone Consumer Protection Act (TCPA)
CAN-SPAM Act
State and federal marketing laws
You represent that you have obtained proper consent from recipients. Business Fuzion does not provide legal advice regarding messaging compliance and is not responsible for violations arising from your use.
7. User Content & Data
You retain ownership of all data and content you upload to the platform (“User Content”).
By using the Services, you grant Business Fuzion a limited, non-exclusive license to process User Content solely to provide and maintain the Services.
You represent and warrant that you have all necessary rights and consents to upload and use User Content.
8. Fees, Billing & Payments
Certain Services require payment. By purchasing a subscription or product, you agree to:
Pay all applicable fees
Authorize recurring billing where applicable
Keep payment information current
Payments are processed through third-party providers (e.g., Stripe). Business Fuzion is not responsible for payment processor errors or interruptions.
All fees are non-refundable, except where required by law or expressly stated otherwise in writing.
9. Suspension & Termination
We may suspend or terminate your access to the Services at any time if:
You violate these Terms
Required fees are not paid
Your use creates legal, technical, or reputational risk
Upon termination:
Your access to the platform will cease
User data may be deleted subject to retention policies
10. Intellectual Property
All platform software, designs, branding, content, and materials provided by Business Fuzion are our intellectual property or licensed to us.
You may not copy, modify, distribute, or reverse engineer any portion of the Services without prior written consent.
11. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
BUSINESS FUZION DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT GUARANTEE RESULTS, UPTIME, LEAD GENERATION, REVENUE, OR BUSINESS SUCCESS.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUSINESS FUZION SHALL NOT BE LIABLE FOR:
INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES
LOSS OF DATA, PROFITS, OR BUSINESS OPPORTUNITIES
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO BUSINESS FUZION IN THE THREE (3) MONTHS PRECEDING THE CLAIM.
13. Indemnification
You agree to indemnify and hold harmless Business Fuzion from any claims, damages, losses, or expenses arising from:
Your use of the Services
Your User Content
Your violation of these Terms or applicable law
14. Governing Law & Venue
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.
Any disputes shall be resolved exclusively in state or federal courts located in Florida.
15. Modifications to Services or Terms
We may modify these Terms or the Services at any time. Continued use of the Services constitutes acceptance of any updates.
16. Assignment
You may not assign these Terms without our prior written consent. Business Fuzion may assign these Terms in connection with a merger, sale, or reorganization.
17. Entire Agreement
These Terms, together with our Privacy Policy and any additional written agreements, constitute the entire agreement between you and Business Fuzion.

2. Opt-Out Instructions
You may opt out of receiving SMS messages at any time by replying STOP to any message you receive from us. After you send STOP, you will no longer receive SMS messages unless you opt in again.
